These Terms of Service (“Terms”) govern your use of the Kinetics Media website (the “Site”), operated by CHC Horizon LLC, 75 E 3rd St, Sheridan, WY 82801, United States (“Kinetics Media”, “we”, “us”). By using the Site you agree to these Terms. If you do not agree, do not use the Site.

Our Privacy Policy explains how we handle personal information and forms part of these Terms.

Kinetics Media arranges editorial coverage for companies and individuals in third-party publications, priced per published placement. The Site describes those services in general terms. It is not an offer, and nothing on the Site creates an engagement.

Any engagement is governed by a separate written agreement, proposal or order that sets out the specific outlets, pricing, timelines, payment terms and deliverables. If that agreement conflicts with these Terms, the agreement controls for that engagement.

Submitting the contact form sends us your inquiry and does not obligate either of us. We aim to reply within 24 to 48 hours but do not guarantee a response or a response time.

You agree that the information you submit is accurate, that you are authorized to provide it, and that you will not submit content that is unlawful, infringing, defamatory, or that you do not have the right to share.

Published coverage appears in publications we do not own or control. Editors decide what they run, how they frame it, and how long it stays online. Unless your written engagement agreement says otherwise, we do not guarantee that any specific outlet will publish, that coverage will remain online, or that it will produce any particular business, search-ranking or immigration outcome.

Where coverage is intended to support a visa or immigration petition, it is one piece of evidence among many. We are not a law firm, we do not give legal advice, and the outcome of any petition is determined solely by the relevant authority.

You may use the Site for lawful purposes only. You must not:

• use the Site in any way that breaks applicable law or infringes anyone’s rights;
• attempt to gain unauthorized access to the Site, its servers or connected systems;
• scrape, crawl or copy the Site’s content in bulk, or interfere with how it works;
• submit automated, bulk or fraudulent form entries.

The Site and its content, including text, design, logos and the Kinetics Media name and marks, are owned by us or our licensors and are protected by copyright and trademark law. You may view the Site and share links to it. You may not reproduce, modify or distribute its content for commercial purposes without our written permission. Publications and logos shown on the Site belong to their respective owners and are referenced for identification only; their appearance does not imply endorsement.

The Site may link to third-party websites, including the publications where coverage appears. We do not control those sites and are not responsible for their content, availability or privacy practices. Links are provided for convenience and do not imply endorsement.

The Site is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components, or that information on it is complete or current.

To the fullest extent permitted by law, CHC Horizon LLC and its members, officers, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to your use of the Site, even if advised of the possibility of such damages. Our total liability for any claim relating to the Site will not exceed one hundred US dollars (US$100). Liability arising under a written engagement agreement is governed by that agreement. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to indemnify and hold harmless CHC Horizon LLC from any claims, losses and expenses, including reasonable legal fees, arising out of your breach of these Terms or your misuse of the Site.

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of laws rules. Any dispute arising out of these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction. Nothing in this section limits any mandatory consumer protections you have under the law of the place where you live.

We may update these Terms from time to time. The effective date at the top shows when they were last revised, and your continued use of the Site after a change means you accept the updated Terms.

If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site.
